The Electoral Count Act of 1887 has never been tested in court, but most of the people who read it have the view that it is ministerial in effect, in that as Mike Pence said, the idea of it is to give Congress this kind of ministerial position of counting the votes, but that it does not entitle any one person, the vice president, or even Congress as a whole to overturn the dually certified results of elections from the states. Kim Strassel: Oh, there is no question in my mind that Mike Pence is right on the facts here. But who do you think is right on the facts here? Kyle Peterson: Kim, the law that governs the electoral counting is horribly muddled and confusing. And Kamala Harris will have no right to overturn the election when we beat them in 2024. Under the constitution, I had no right to change the outcome of our election. And frankly, there is no idea more un-American than the notion that any one person could choose the American president.
